The rules for using Lumana—a cozy walking companion game for users aged 17 and older.
Audience: 17+Lumana turns manually logged walks into a cozy adventure with a buddy you care about.
These Terms of Use (“Terms”) are a binding agreement between you and Lumana Team regarding the Lumana mobile application and related services (the “App”).
Every walk is an adventure waiting to happen. Lumana is a cozy walking companion game where you manually log completed walks to add step progress, complete quests, and care for a tiny buddy. The displayed step progress is added through your manual action; Lumana does not automatically measure, verify, or import steps from Apple Health or motion sensors.
Lumana does not require subscriptions, display advertisements, or require a cloud account. Your profile, selected avatar, and game progress are stored locally on your device.
You must be 17 or older and agree to these Terms to use Lumana.
By accessing or using the App, you agree to these Terms and our Privacy Policy. You represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms, to the extent permitted by law.
We give you a personal license to use Lumana—you do not own the App itself.
Subject to these Terms, Lumana Team grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control for personal, non-commercial entertainment and wellness-motivation purposes.
You may not copy, modify, distribute, sell, lease, or sublicense the App except as allowed by law; reverse engineer the App except where prohibited restrictions are unlawful; circumvent security; use the App to build a competing product from non-public aspects; or remove proprietary notices.
All rights not expressly granted are reserved by Lumana Team and its licensors.
Lumana uses a local profile and does not create a cloud account.
You may choose a buddy name and profile image. This information and your game progress are stored locally on your device. No username, password, or cloud account is created. You are responsible for safeguarding access to your device.
Support communications should be truthful and respectful.
Lumana motivates walking—it is not medical advice, and you walk at your own risk.
The displayed steps, XP, quests, streaks, and goals are game elements for engagement and personal motivation only. Displayed steps are added when you manually log a walk and are not automatically measured or verified by device sensors. You are solely responsible for consulting professionals when appropriate, choosing safe goals and routes, obeying traffic and local laws, and staying aware of your surroundings.
To the maximum extent permitted by law, Lumana Team is not liable for injuries, property damage, or other harm arising from physical activity or outdoor walking associated with use of the App.
Camera and photo access are used only when you choose a profile image.
If you choose to set a profile image, you may use the camera or system photo picker. You control these permissions in device settings. The current version does not request location, HealthKit, motion, fitness, microphone, advertising tracking, or physical step-count data.
Do not misuse the App.
Buddy names and selected profile images remain locally on your device and are not uploaded to Lumana Team. If you contact support by email, you retain ownership of the content you send and authorize us to use it only to respond and handle your request.
You agree not to use the App for unlawful or abusive purposes; upload malware or infringing content; interfere with the App or related services; misrepresent your identity; scrape or manipulate data without permission; or exploit bugs in a harmful way.
Lumana does not perform facial recognition, biometric identification, image generation, or server-side image processing.
Buddies, XP, snacks, toys, and streaks are virtual and have no real-world cash value.
Buddy companions, XP, quests, snacks, toys, streak shields, milestones, and similar items are virtual and licensed—not sold. They have no monetary value outside the App and are not redeemable for cash, except where required by mandatory law.
Lumana currently does not offer subscriptions or advertisements. If paid features are introduced later, additional terms will be presented before purchase.
Lumana’s name, art, code, and design belong to Lumana Team.
The App—including software, design, characters (Sprout, Ember, and Bubble), artwork, text, trademarks, and logos—is owned by Lumana Team or its licensors. Feedback you provide may be used by us without obligation to compensate you.
How we handle personal information is described in our Privacy Policy.
Your use of Lumana is also governed by our Privacy Policy, which explains local game storage, optional profile images, and information you voluntarily send when contacting support.
For privacy requests (access, correction, deletion, restriction, or withdrawal of consent), contact shairalombardo@icloud.com. We aim to respond within 5 business days.
Apple’s rules also apply when you download from the App Store.
If you download Lumana from the Apple App Store, you acknowledge that these Terms are between you and Lumana Team, not Apple; Apple has no obligation to provide maintenance or support; Apple’s warranty obligation is limited as described under Apple’s standard terms; Apple is not responsible for claims relating to the App; Apple and its subsidiaries are third-party beneficiaries of these Terms; and you must comply with applicable third-party terms.
The App is provided as-is, within the limits of applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMANA IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted or error-free. Displayed step progress is manually initiated and is not a sensor-based step or location measurement.
Our liability is limited as far as the law allows.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMANA TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50).
Nothing excludes liability that cannot be excluded under applicable law.
You are responsible for harm caused by your misuse of the App.
To the maximum extent permitted by law, you agree to indemnify and hold harmless Lumana Team from claims, damages, losses, and expenses arising out of your misuse of the App, your violation of these Terms, or your violation of any third-party rights.
You may leave anytime; we may suspend access for violations.
You may stop using Lumana at any time and delete the App. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the App. Provisions that should survive (including IP, disclaimers, liability limits, indemnity, governing law, and arbitration) will survive.
Disputes follow the law of our principal place of business and binding arbitration.
These Terms are governed by the laws of the jurisdiction of Lumana Team’s principal place of business, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively through binding arbitration, except where prohibited by applicable law. Class actions are waived to the extent permitted by law. Either party may seek provisional injunctive relief to protect intellectual property, or pursue eligible small-claims court actions.
These Terms are the full agreement for using Lumana.
If any provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any in-App disclosures, constitute the entire agreement regarding the App.
